Welcome to Messages – Text Messages.

These Terms of Use ("Terms") govern your access to and use of the Messages – Text Messages mobile application ("App", "we", "our" or "us").

The App provides SMS and MMS messaging, conversation management, scheduled messaging, SMS blocking, contact integration and optional home launcher functionality.

By downloading, installing or using the App, you agree to these Terms. If you do not agree with these Terms, please discontinue using the App.

1. ACCEPTANCE OF TERMS

By accessing or using the App, you confirm that:

You have read and understood these Terms.

You agree to comply with applicable laws and regulations.

You will use the App only for lawful purposes.

You will not misuse the messaging or launcher functionality.

You have the authority to grant the permissions required for the features you use.

2. APPLICATION FEATURES

The App may provide the following features, depending on your device, Android version and application configuration.

2.1 SMS and MMS Messaging

The App allows users to send and receive SMS and MMS messages.

To use the complete messaging functionality, you must select Messages as your default SMS application through the Android system interface.

You are responsible for ensuring that:

You have permission to communicate with the intended recipients.

The messages you send comply with applicable laws.

Your use of SMS and MMS services complies with your mobile carrier's terms.

You do not use the App for spam, fraud, harassment or unlawful communications.

2.2 Scheduled SMS

The App may allow you to schedule text messages for delivery at a selected date and time.

Scheduled message delivery may depend on:

Device availability.

SIM card availability.

Mobile network connectivity.

Android background execution restrictions.

Battery optimization settings.

Default SMS application status.

Other system or carrier restrictions.

We do not guarantee that every scheduled message will be delivered at the exact selected time.

You are responsible for reviewing scheduled messages and ensuring their content and recipients are correct.

2.3 SMS Blocking

The App may provide functionality to block unwanted SMS senders.

Blocking behaviour may depend on Android's messaging system, device configuration and default SMS application status.

We do not guarantee that every unwanted or spam message will be identified or blocked.

2.4 Contacts Integration

The App may access contacts, with your permission, to display contact names and help select message recipients.

You are responsible for ensuring that your use of contact information complies with applicable privacy and communication laws.

2.5 Home Launcher Functionality

The App may provide optional home launcher functionality.

You may choose to select Messages as your device's default Home application through Android settings.

When enabled, the App may provide supported home screen and application-launching features.

The following conditions apply:

Selecting Messages as your default Home application is voluntary.

The App will not change your default Home application without your knowledge and consent.

Launcher features depend on the device and Android version.

You can change your default Home application through your device settings.

The App does not guarantee compatibility with every third-party application or device customization.

The home launcher functionality is separate from SMS and MMS messaging.

3. DEFAULT APPLICATION REQUIREMENTS

Certain messaging features require Messages to be selected as your device's default SMS application.

Android controls default application selection and the permissions available to default applications.

If you change your default SMS application, certain messaging features may become unavailable.

Similarly, launcher features that require default Home application status may stop functioning when another launcher is selected.

You are free to change these settings at any time through Android system settings.

4. USER RESPONSIBILITIES

You agree not to:

Send unsolicited bulk messages or spam.

Send fraudulent, deceptive or misleading messages.

Harass, threaten, abuse or impersonate other individuals.

Use the App for illegal communications.

Violate another person's privacy or intellectual property rights.

Attempt to bypass Android security or permission controls.

Interfere with the App's operation or security.

Use the App to distribute malicious links, malware or harmful content.

Use the App in violation of mobile carrier restrictions.

Misuse installed application or launcher information.

You are solely responsible for the content of messages you send and the manner in which you use the App.

5. SMS AND MMS CHARGES

Messages does not independently provide free cellular SMS or MMS services.

Sending and receiving SMS or MMS messages may incur charges imposed by your mobile network operator.

You are responsible for:

Your mobile subscription.

SMS and MMS charges.

International messaging charges.

Data charges, where applicable.

Any additional carrier fees.

We are not responsible for charges imposed by your mobile operator.

6. ADVERTISING AND THIRD-PARTY SERVICES

The App may display advertisements through Google Mobile Ads and supported advertising mediation partners.

These services may include InMobi, ironSource, Vungle, Meta Audience Network and Pangle.

The availability and content of advertisements may vary by country, device, consent settings and advertising configuration.

We do not control every advertisement displayed by independent advertising providers.

Your interaction with third-party advertisements, websites or services may be subject to their own terms and privacy policies.

7. INTELLECTUAL PROPERTY

The App, including its original design, interface, graphics, logos, software, branding and associated content, is protected by applicable intellectual property laws.

You may use the App for personal and lawful purposes.

You may not:

Copy or redistribute the App without authorization.

Reverse engineer or decompile the App except where permitted by applicable law.

Modify or create unauthorized derivative versions.

Remove copyright or proprietary notices.

Use our branding or intellectual property without permission.

All rights not expressly granted under these Terms remain reserved by their respective owners.

8. THIRD-PARTY SOFTWARE AND SERVICES

The App may incorporate third-party libraries and services to provide functionality, including:

Google Firebase.

Google Mobile Ads.

InMobi.

ironSource.

Vungle.

Meta Audience Network.

Pangle.

Other supporting Android and Google services.

Such services may be governed by separate third-party terms and policies.

We are not responsible for independent services, external websites or third-party products that are outside our reasonable control.

9. AVAILABILITY AND SERVICE INTERRUPTIONS

We aim to provide a reliable application experience. However, we do not guarantee uninterrupted or error-free operation.

Certain functionality may be affected by:

Android operating system updates.

Device manufacturer restrictions.

SIM card or carrier problems.

Internet or mobile network interruptions.

Permission changes.

Background execution restrictions.

Third-party service outages.

Software compatibility issues.

We reserve the right to update, modify, suspend or discontinue features where reasonably necessary, subject to applicable law.

10. DISCLAIMER OF WARRANTIES

The App is provided on an "as available" and "as is" basis to the extent permitted by applicable law.

We do not guarantee:

Uninterrupted application availability.

Successful delivery of every SMS or MMS message.

Exact execution times for scheduled messages.

Detection of every spam message.

Compatibility with every Android device.

Availability of every third-party launcher or advertising service.

Users should not rely on the App as the sole means of emergency communication.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the App.

This includes, where legally permissible:

Delayed or failed message delivery.

Carrier service interruptions.

Device compatibility issues.

Loss of locally stored application information.

Third-party service interruptions.

Unauthorized access resulting from compromised user devices.

User misuse of messaging functionality.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

12. PRIVACY

Your use of the App is also governed by our Privacy Policy.

The Privacy Policy explains how information may be accessed, processed, stored and shared through messaging, contacts, launcher functionality, analytics and advertising services.

Please review the Privacy Policy before using the App.

13. SUSPENSION AND TERMINATION

You may stop using the App at any time by uninstalling it or changing your default application settings.

We may restrict or discontinue access to certain functionality if necessary to:

Protect the security of the App.

Prevent unlawful or abusive usage.

Comply with applicable laws.

Address technical or operational issues.

Termination or uninstallation does not necessarily remove SMS messages stored in the device's system messaging database or information already processed by independent third-party providers.

14. CHANGES TO THESE TERMS

We may revise these Terms from time to time to reflect changes in application functionality, third-party services, business operations or legal requirements.

Updated Terms will be published through the App or our designated website.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

15. GOVERNING LAW

These Terms shall be governed by the laws of India, subject to applicable consumer protection and other mandatory legal requirements.

Any disputes arising in connection with these Terms shall be handled by the competent courts having jurisdiction under applicable law.
